Making a Claim

At first, making a claim may seem daunting. It may seem like an over complicated task with many different avenues. Our claims process is straightforward and designed to give our clients a simple experience and clear understanding of how their claim will progress.

1. Start a claim

Our New Client Unit will contact you and help you to confirm all the details of your claim such as; your contact details, details of the accident circumstance, any injuries and financial losses you have suffered following the accident. Some of the information can be provided by you using a secure online client account we will create for you.

2. Treatment

If you have been injured, we will help you access the treatment you need. Common treatments for whiplash injuries include medication such as painkillers or physiotherapy.

3. Evidence gathering

We will arrange for an independent medical expert to provide a report on your injuries. We will also ask you for the details of financial losses you have suffered as a result of the accident and for evidence of each loss. You will be able to upload details of these and supporting documents on your online client account!

4. Compensation

Once we have completed gathering the evidence for your claim, we will advise you what level of compensation you should receive for your injuries, financial losses and any treatment or care you need. We will submit the details to the compensating insurer. Your compensation will either be agreed with the insurer or decided by the court. The vast majority of cases are settled without the need to go to court but if you do need to go to court our specialist team will be there to support you every step of the way.

5. Time limits for making a claim

You have 3 years to make a claim for injury (and 6 years for financial losses). If your injuries take longer to resolve, then we will ensure that your interests are protected. This means ensuring that the relevant court papers are issued at court in time. Exceptions to this are:

  • Minors: If a child is making or claim they will have until their 21st birthday to bring a claim.
  • Mental Capacity: If someone lacks mental capacity there is no time limit for bringing a claim.
  • Deceased: If someone is fatally injured, the family has 3 years from the date their beloved one died.

6. Legal costs

If you have legal expenses insurance, you will not have to pay anything to make your claim. If you have entered into a Conditional Fee Arrangement with us a portion of your compensation will cover our fees.
