Fatal accident claims

Whilst compensation may be a secondary thought, in law, compensation can be sought from the person who is found to be at fault for the accident. The types of loss you can potentially recover are:

How to make a claim

If you or a family member have been involved in an accident that is not your fault, please contact us as soon as possible. Claims for personal injury or death arising out of accidents which take place in England and Wales are subject to a three year limitation period. How will my claim be funded?

You may have legal expenses insurance attached to your car or home insurance policy. We can make enquiries to see if any such legal expense insurance exists and can be used to fund your claim. If you do not have existing legal expenses insurance we can enter into a Conditional Fee Agreement and a bespoke policy of after the event legal expenses insurance. Under the terms of a conditional fee agreement, you may be charged a fee for our services.

How long will my claim take?

We aim to conclude your claim as soon as is possible. The length of time this takes depends very much on the time taken to establish fault (which can depend upon the conclusion of the police/coroner’s enquiries), extent of the loss and the third party insurer’s approach. It is important that we fully assess any future losses before attempting to settle your claim.

How much compensation will I receive?

Kate's Story

Kate became a para-dressage rider in 2009 after she was injured in an eventing accident.

Kate sustained a serious head and brain injury, which left her having to learn to walk and talk again. Kate then suffered multiple injuries including a brain injury and a brachial plexus injury in a road traffic accident in 2013.
