Jargon Buster

Our jargon buster contains the definitions of some of the terms commonly used throughout this website.


Claimant

A person making a claim.


CLEX

Client Extra Account. This is your online portal, which allows you to upload evidence of your losses, obtain an update on your claim and communicate with your case handler.


CNF (Claim Notification Form)

This form is sent to the other party’s insurers, detailing your injuries/losses and providing our version of events


Compensation

Something, typically money, awarded to someone in recognition of a loss, suffering or injury.


Defendant/Other Side

The person against whom the claim is being made.


Defendant Insurer/Other Side Insurer

The insurance company representing the person against whom the claim is being made


General Damages (Quantum)

The amount of compensation awarded for your injuries.


Liability

Liability is what we need to establish to prove who is wholly or partially at fault for an accident. Someone is liable if it can be shown that they have acted negligently, that is, they have not shown an appropriate duty of care to other road users


Limitation

The amount of time in which a person is eligible to make a claim for personal injury or financial losses. Ordinarily this is 3 years from the date of the accident, unless the person making the claim is a child.


Litigation

A matter brought to court when matters cannot be resolved with the other party’s representatives


Low Velocity Impact

When the impact of the incident is minor and the speed is low.


MOJ (Ministry of Justice)

Refers to a streamlined claims process that deals solely with claims in which the other side has accepted full responsibility


Motor Insurers’ Bureau

We will work with this government organisation should you have been involved in an accident with a third party who is not insured or we cannot trace


Negligence

When someone has not behaved with the reasonable care the law requires.


Special Damages

Any financial losses incurred as a result of the accident. For example, vehicle excess, medical expenses, loss of earnings etc.
