Jargon buster

Our jargon buster contains the definitions of some of the terms commonly used throughout this website.

Liability
Something for which someone is responsible; an obligation, an accident, a debt or responsibility. In the circumstance of a Road Traffic Accident, it means fault for the accident.
Negligence
When someone has not behaved with the reasonable care the law requires.
Claimant
A person making a claim.
Defendant
The person against whom the claim is being made.
General Damages (Quantum)
The amount of compensation the claimant is awarded for their injury claim.
Special Damages
Any financial losses the claimant has as a result of the accident. For example, excess, medical expenses, loss of earnings.
Compensation
Something, typically money, awarded to someone in recognition of a loss, suffering or injury.
Limitation
The amount of time in which a person is eligible to make a claim for personal injury or financial losses.
Litigation
An action brought to court to enforce a particular right.
Low Velocity Impact
When the impact of the incident is minor and the speed is low.
